आज हम आपको ऐसी घटना के बारे में बताएँगे जो प्रतिदिन भारत के किसी न किसी घर में घटती रहती है | 

आज हमारे सभ्य समाज में भी प्रत्येक महिला को अपने संपूर्ण जीवन काल में कभी न कभी किसी न किसी रूप में सहनी पड़ती है हमारे देश में घरेलु हिंसा का मुख्य दोषी पति को माना जाता है परन्तु ऐसा नहीं है अमूमन यह देखा गया है कि वह परिवार का कोई भी सदस्य हो सकता जैसे की सास -ससुर , देवर -देवरानी ,ननद और जेठ -जेठानी भी हो सकते है कई बार संपत्ति का विवाद भी घरेलु हिंसा का रूप ले लेता है | ज्यादातर महिलाएं अपनी इज्जत और सामाजिक अपमान के डर से वो अपने माता पिता को भी नहीं बताती है की उनके साथ ये दुर्व्यवहार हो रहा है वो ये सोंचकर चुप हो जाती है की उन्हें रहना अपने पति के साथ ही है और पूरा जीवन उसी के साथ गुजारना है | जैसे जैसे महलाएं जागरूक हुई और शिक्षित हुई उन्होंने अपने साथ हो रहे अत्याचारो को खुल कर साझा किया और उसके लिए उन्होंने क़ानून का सहारा लिया | भारत सरकार ने घरेलु हिंसा को रोकने की लिए कड़े कानून बनाएँ  है 

घरेलू हिंसा से महिला संरक्षण अधिनियम, 2005 भारत की संसद द्वारा पारित एक अधिनियम है जिसका उद्देश्य घरेलू हिंसा से महिलाओं को बचाना है और पीड़ित महिलाऔं को कानूनी सहायता उपलब्ध कराना है। यह २६ अक्टूबर २००६ को लागू हुई।

घरेलू हिंसा क्या है?

शारीरिक दुर्व्यवहार अर्थात शारीरिक पीड़ा, अपहानि या जीवन या अंग या स्वास्थ्य को खतरा या लैगिंग दुर्व्यवहार अर्थात महिला की गरिमा का उल्लंघन, अपमान या तिरस्कार करना या अतिक्रमण करना या मौखिक और भावनात्मक दुर्व्यवहार अर्थात अपमान, उपहास, गाली देना या आर्थिक दुर्व्यवहार अर्थात आर्थिक या वित्तीय संसाधनों, जिसकी वह हकदार है, से वंचित करना,मानसिक रूप से परेशान करना ये सभी घरेलू हिंसा कहलाते हैं।

इस क़ानून के तहत घरेलू हिंसा के दायरे में अनेक प्रकार की हिंसा और दुर्व्यवहार आते हैं। किसी भी घरेलू सम्बंध या नातेदारी में किसी प्रकार का व्यवहार, आचरण या बर्ताव जिससे (१) आपके स्वास्थ्य, सुरक्षा, जीवन, या किसी अंग को कोई क्षति पहुँचती है, या (२) मानसिक या शारीरिक हानि होती है, घरेलू हिंसा है।

इसके अलावा घरेलू सम्बन्धों या नातेदारी में, किसी भी प्रकार का

• शारीरिक दुरुपयोग (जैसे मार-पीट करना, थप्पड़ मारना, दाँत काटना, ठोकर मारना, लात मारना इत्यादि),
• लैंगिक शोषण (जैसे बलात्कार अथवा बलपूर्वक बनाए गए शारीरिक सम्बंध, अश्लील साहित्य या सामग्री देखने के लिए मजबूर करना, अपमानित करने के दृष्टिकोण से किया गया लैंगिक व्यवहार, और बालकों के साथ लैंगिक दुर्व्यवहार),
• मौखिक और भावनात्मक हिंसा ( जैसे अपमानित करना, गालियाँ देना, चरित्र और आचरण पर आरोप लगाना, लड़का न होने पर प्रताड़ित करना, दहेज के नाम पर प्रताड़ित करना, नौकरी न करने या छोड़ने के लिए मजबूर करना, आपको अपने मन से विवाह न करने देना या किसी व्यक्ति विशेष से विवाह के लिए मजबूर करना, आत्महत्या की धमकी देना इत्यादि),
• आर्थिक हिंसा ( जैसे आपको या आपके बच्चे को अपनी देखभाल के लिए धन और संसाधन न देना, आपको अपना रोज़गार न करने देना, या उसमें रुकावट डालना, आपकी आय, वेतन इत्यादि आपसे ले लेना, घर से बाहर निकाल देना इत्यादि), भी घरेलू हिंसा है।

व्यथित व्यक्ति के अधिकार

• पीड़ित इस कानून के तहत किसी भी राहत के लिए आवेदन कर सकती है जैसे कि - संरक्षण आदेश,आर्थिक राहत,बच्चों के अस्थाई संरक्षण (कस्टडी) का आदेश,निवास आदेश या मुआवजे का आदेश
• पीड़ित आधिकारिक सेवा प्रदाताओं की सहायता ले सकती है
• पीड़ित संरक्षण अधिकारी से संपर्क कर सकती है
• पीड़ित निशुल्क क़ानूनी सहायता की मांग कर सकती है
• पीड़ित भारतीय दंड संहिता (IPC) के तहत क्रिमिनल याचिका भी दाखिल कर सकती है, इसके तहत प्रतिवादी को तीन साल तक की जेल हो सकती है, इसके तहत पीड़ित को गंभीर शोषण सिद्ध करने की आवश्यकता हैl

घरेलू हिंसा का उजागर न हो पाना  मुख्य कारण अशिक्षा और जागरूकता का आभाव है महिलाओं को आत्मनिर्भर बनना होगा ताकि व शादी के बाद पूर्ण रूप से पति पर आश्रित न हो और ऐसे घटना होने पर बिना झिझके हुए क़ानूनी लड़ाई लड़ लड़ सकती है 

हमारे देश में लगभग हर साल ५.२ % /लाख केस घरेलू हिंसा के दर्ज होते है परन्तु मेरा ऐसा मानना है की पचास प्रतिशत केस महिलाएं सामाजिक प्रतिष्ठा को बचने के लिए दर्ज ही नहीं कराती है|  जो भी लोग इस पोस्ट को पढ़ रहे होंगे उनसे यही प्रार्थना है की महिलाओं का सम्मान करें वह हमारे जीवन और समाज का अभिन्न अंग है इस जगत की जननी है महिलाओं के बिना सृष्टि अधूरी है हमारे सम्पूर्ण जीवन काल में वह कभी माँ, बहन और  पत्नी के रूप में  साथ देती | आज सभी क्षेत्रो में महिलाएं बराबरी से आगे बढ़ रही है चाहे वह राजनीति हो या शिक्षा हो मनोरंजन हो या खेल हो | 

आपका एक कदम सामाजिक सुधार की ओर हम सब को ले जायेगा इसलिए घरेलू हिंसा न करे और न ही घर- परिवार और आसपास होने दे जो ऐसा करता हो उसके खिलाफ आवाज़ उठायें |

The Protection of Women from Domestic Violence Act, 2005 is an Act passed by the Parliament of India which aims to protect women from domestic violence and provide legal assistance to the victims. It came into force on 24 October 2007.

What is domestic violence?

Physical abuse ie physical pain, abduction or threat to life or limb or health or lagging abuse ie violating, insulting or insulting or encroaching on a woman's dignity or verbal and emotional abuse ie insulting, ridiculing, abusing or financial abuse ie economic or Depriving the financial resources to which it is entitled, mentally disturbing all these domestic violence Called.

Under this law, various forms of violence and abuse come under the purview of domestic violence. Any type of behavior, conduct or behavior in any domestic relationship or relationship that (1) causes any damage to your health, safety, life, or any organ, or (2) causes mental or physical harm is domestic violence.

Also in domestic relationships or kinship, any kind of

Physical abuse (eg beating, slapping, biting teeth, kicking, kicking etc.),

Sexual abuse (such as rape or coercive physical relationships, forced viewing of pornography or content, sexual behavior from a point of view of humiliation, and sexual abuse of children),

Verbal and emotional violence (such as humiliating, abusing, accusing character and conduct, harassing when you are not a boy, harassing in the name of dowry, forcing you not to work or quit, not marrying your mind Giving or forcing a person to marry, threatening suicide, etc.),

Financial violence (such as not giving you or your child money and resources to take care of you, not allowing you to do your employment, or hindering it, taking your income, salary, etc. out of your home, getting them out of the house etc.), also domestic There is violence.

Rights of aggrieved person

The victim can apply for any relief under this law such as - Protection Order, Economic Relief, Temporary Protection of Children (Custody) Order, Residence Order or Compensation Order

The victim can also file a criminal petition under the Indian Penal Code (IPC), under which the defendant can be jailed for up to three years, under which the victim needs to prove serious exploitation.

The main reason for not being exposed to domestic violence is the lack of illiteracy and awareness that women will have to become self-sufficient so that they do not become completely dependent on the husband after marriage and can fight a legal battle without any hesitation in the event of such incident.

In our country, about 52% / lakh cases of domestic violence are registered every year, but I believe that fifty percent of the cases are not filed by women to save social prestige. It is a prayer to all those who are reading this post that they should respect women. It is an integral part of our life and society. The mother of this world is incomplete without women. In our entire life, she is sometimes mother, sister and wife. Accompanies as Today, women are advancing equally in all areas, whether it is politics or education, entertainment or sports.
